It seems that a man was lost driving in the country and drove his car into a ditch while trying to read his map. Unable to get the car out, the man walked to the nearest farmhouse looking for help. The farmer immediately offered the assistance of his old mule named Warwick. While the man doubted whether such an old and broken-down looking mule could really help, he didn’t have much choice but to try. When the man and the farmer reached the car, the farmer snapped the reins and called out “Pull Fred! Pull Jack! Pull Ted! Pull Warwick!” And then, to the great surprise of the man, Old Warwick pulled his car right out of the ditch. Amazed, the man asked the farmer why he yelled out for other names to pull when there was only one mule. The wise old farmer just chuckled and told the man that Warwick was nearly blind and that, as long as he thinks he’s pulling as a part of a team, he gets the job done for the team. Changing West Virginia’s attitude on teamwork can make the difference, just like Warwick did for the stranded motorist. Q practices in this article, the EEOC encourages employ- ers to develop a narrowly tailored written policy and procedure for screening applicants with respect to crimi- nal conduct and maintaining a record of consultations and research considered in crafting this policy. Other best practices include eliminating policies or practices that exclude individuals from employment based on any criminal record and training managers, hiring officials and decision-makers about Title VII and its prohibition on employment discrimination. In conclusion, while the EEOC’s Guidance is not binding and takes some expansive positions not required by current law, it may be given deference by courts and represents the standard that the EEOC will use in evaluating discrimination complaints. Therefore, employers should reexamine their background check policies in light of the EEOC’s updated Guidance.
